Serán susceptibles de recurso especial en materia de contratación previo a la interposición de recurso contencioso-administrativo y sin que proceda la interposición de recursos administrativos ordinarios, los actos relacionados en el artículo 44 de la Ley 9/2017, de 8 de noviembre, de Contratos del Sector Público, por la que se transponen al ordenamiento jurídico español las Directivas del Parlamento Europeo y del Consejo 2014/23/UE y 2014/24/UE, de 26.2.2014 (a partir de ahora, LCSP).
El procedimiento de recurso se iniciará mediante escrito que deberá presentarse en el plazo de quince días hábiles contados en los parámetros establecidos en el artículo 50 de la LCSP. Contra la resolución del recurso especial en materia de contratación solo procederá la interposición del correspondiente recurso contencioso-administrativo tal y como establece el artículo 49 de la LCSP.
Alternativamente, se puede interponer directamente recurso contencioso-administrativo ante la Sala de lo Contencioso-Administrativo del Tribunal Superior de Justicia de Cataluña en el plazo de dos meses a contar desde el día siguiente de la notificación del acto impugnado, sin perjuicio que se pueda interponer cualquier otro recurso que se considere oportuno.
