Procedure Type

  • Notice type: Contract Award Notice (Change Notice)
  • Procedure: Negotiated procedure without prior call for competition
  • Legal basis: Directive 2014/24/EU
  • Contract form: DBFM (Design, Build, Finance and Maintain) – modification of existing contract
  • Framework agreement: No
  • Dynamic purchasing system: No

The modification concerns the DBFM contract awarded in 2014 for the widening of the A9 Gaasperdammerweg, including tunnel infrastructure and the Holendrecht–Diemen interchange (Project SAA-A9-Gaasperdammerweg).

Scope of Works

The modification relates to the existing DBFM contract for:

  • Design
  • Construction
  • Financing
  • 20-year maintenance period (until 25 June 2038)

covering the widened A9 Gaasperdammerweg, including the tunnel and associated interchange works.

During project implementation, issues arose that could not be resolved without a formal Employer’s Modification. The modification has a duration of 12 months (overall lot duration indicated as 24 months).

The bundled publication serves as a corrective measure to retroactively comply with publication obligations for modifications not previously published.

Detailed changes are set out in the annex:
“Wijzigingen Gaasperdammertunnel onder artikel 2.163e AW 2012”.

Tunnel Details

  • Tunnel name: Gaasperdammertunnel
  • Type: Road tunnel (part of widened A9 motorway corridor)
  • CPV classification: 45221241 – Road tunnel construction work
  • Location: Amsterdam, Groot-Amsterdam (NL32B), Netherlands
  • Contract model: Integrated DBFM

The modifications were necessitated by:

  • New technical insights emerging during execution
  • Updated safety standards
  • Additional requirements for tunnel technical installations
  • Stricter national and European requirements relating to tunnel safety, cybersecurity and availability
  • Changed regional conditions due to concurrent major infrastructure projects in Amsterdam (A1, A10, A4 and municipal works), creating unforeseen dependencies and safety risks

The contracting authority determined that:

  • The circumstances could not reasonably have been foreseen at contract award (Article 2.163e Dutch Public Procurement Act 2012)
  • The nature of the contract was not altered
  • The modification remained proportionate
  • The amendment was necessary to ensure safety and operational continuity

Contract Value

  • Total value of modification(s): EUR 803,721,500
  • Procurement not financed by EU funds
  • Covered by GPA: Yes

Duration

  • Lot duration: 24 months
  • Modification implementation period: 12 months
  • Original DBFM maintenance period runs until 25 June 2038
