Zadavatel v souvislosti s tímto rozhodnutím doplnil čl. 8. 2 zadávací dokumentace, který obsahuje požadavky na poddodavatele účastníka. Zadavatel v souvislosti s tímto požadavkem poskytuje dodavatelům závazný vzor čestného prohlášení o poddodavatelích (příloha č. 3f) a čestného prohlášení poddodavatele (Příloha č. 3g). Zadavatel v návaznosti na doplnění zadávací dokumentace blíže popsané výše dále relevantně tyto požadavky na poddodavatel promítl i do rámcové dohody. III.1)Podmínky účasti
III.1.1)Profesní kvalifikační předpoklady dodavatelů, včetně požadavků týkajících se registrace v profesních nebo jiných rejstřících
Seznam a stručný popis podmínek:
Výpis z obchodního rejstříku či jiné obdobné evidence.Platné oprávnění k podnikání.
Dodavatel předloží výpisy z živnostenského rejstříku dle § 10 odst. 3 písm. a) zákona č. 455/1991 Sb., o živnostenském podnikání (živnostenský zákon), ve znění pozdějších předpisů, a/nebo živnostenské listy, resp. jiná oprávnění k podnikání v předmětu podnikání: (i) výkon zeměměřických činností;
(ii) montáž, opravy, revize a zkoušky elektrických zařízení;
(iii) výroba, obchod a služby neuvedené v přílohách 1 až 3 živnostenského zákona;
(iv) výroba, instalace, opravy elektrických strojů a přístrojů, elektronických a telekomunikačních zařízení.
Zadavatel uzná za průkaz oprávnění k podnikání v požadovaném předmětu rovněž výpis z živnostenského rejstříku nebo živnostenský list či listy dokládající oprávnění dodavatele k podnikání v předmětu (či předmětech), který bude zadavatelem požadovanému předmětu obsahově odpovídat (jedná se zejména o živnostenské listy vydané za dříve platné právní úpravy). Čestné prohlášení dodavatele (formulář 2.1.1.), ze kterého bude vyplývat, že disponuje osobou/osobami, jejímž/jejichž prostřednictvím zabezpečuje odbornou způsobilost, včetně dále uvedených dokladů o odborné způsobilosti:
(i) osoba, jejímž prostřednictvím dodavatel zabezpečuje odbornou způsobilost podle § 6 nařízení vlády č. 194/2022 Sb., o požadavcích na odbornou způsobilost k výkonu činnosti na elektrických zařízeních a na odbornou způsobilost v elektrotechnice, resp. podle § 6 vyhlášky Českého úřadu bezpečnosti práce a Českého báňského úřadu č. 50/1978 Sb., o odborné způsobilosti v elektrotechnice, ve znění pozdějších předpisů, předloží Osvědčení absolvování odborného školení podle § 6 nařízení vlády č. 194/2022 Sb., o požadavcích na odbornou způsobilost k výkonu činnosti na elektrických zařízeních a na odbornou způsobilost v elektrotechnice, resp. podle § 6 vyhlášky Českého úřadu bezpečnosti práce a Českého báňského úřadu č. 50/1978 Sb., o odborné způsobilosti v elektrotechnice, ve znění pozdějších předpisů;
(ii) osoba, jejímž prostřednictvím dodavatel zabezpečuje odbornou způsobilost v provádění prohlídek tunelů předloží Oprávnění k provádění prohlídek tunelů na pozemních komunikacích, vydané Ministerstvem dopravy ČR;
(iii) osoba, jejímž prostřednictvím dodavatel zabezpečuje odbornou způsobilost v oboru geotechnika předloží doklad či osvědčení o autorizaci jako „autorizovaný inženýr“ v oboru „geotechnika“ dle § 5 odst. 1 a 3 písm. i) zákona č. 360/1992 Sb., o výkonu povolání autorizovaných architektů a o výkonu povolání autorizovaných inženýrů a techniků činných ve výstavbě, v platném znění;
(iv) osoba, jejímž prostřednictvím dodavatel zabezpečuje odbornou způsobilost v oblasti hydrogeologie předloží Osvědčení o odborné způsobilosti v oboru hydrogeologie vydané Ministerstvem životního prostředí ČR dle § 3, odst. 3 zákona ČNR č. 62/1988 Sb., o geologických pracích a o Českém geologickém úřadu, ve znění pozdějších předpisů a vyhlášky Ministerstva životního prostředí ČR č. 206/2001 Sb., o osvědčení odborné způsobilosti projektovat, provádět a vyhodnocovat geologické práce
(v) osoba, jejímž prostřednictvím dodavatel zabezpečuje odbornou způsobilost v oblasti požární ochrany předloží Osvědčení o odborné způsobilosti vydané Ministerstvem vnitra ČR dle § 11 odst. 1 a § 11 odst. 2 zákona č. 133/1985 Sb., o požární ochraně, ve znění pozdějších předpisů.
